These Terms of Use govern use of the Tattoo Travelist Membership (the "Platform") offered by Tattoo Travelist, LLC (the “Company”).

By accessing the Platform or submitting any comments, ideas, content, personally identifiable information, photographs, or other information (“Content”) while using the Platform, you agree that you are subject to and will comply with these Terms of Use, which may be updated from time to time. We reserve the right to modify the Terms of Use at any time and we also reserve the right to waive or modify any of these terms as they apply to a specific posting or user without relation to other users’ postings. Your continued use of the Program constitutes your acceptance of any updated terms.

These Terms of Use do not create a partnership, franchise, joint venture, agency, fiduciary or employment relationship between you and Tattoo Travelist. You may not assign your rights or obligations under these Terms of Use.

 

Personal Responsibilities

 

You agree you shall:

• Treat other Tattoo Travelist Platform users with courtesy and respect

• Be responsible for your compliance with these Terms of Use and all activities occurring within or from your Tattoo Travelist Platform account

• Use reasonable efforts to ensure no unauthorized access to or use of the Platform

• Be responsible for your compliance with your employer’s policies and requirements and be responsible for compliance with any regulatory or legal requirement you may be subject to as a result of your employment, residence or role within an organization.

• Use the Platform only in accordance with these Terms, for its intended purpose and in compliance with all applicable laws and government regulations

You agree that you shall not:

• Impersonate any other person or company;

• Falsely say or imply you are associated with Tattoo Travelist, it’s third-party service providers, another person or entity;

• Share or post any Content that is, or may reasonably be considered to be, obscene, pornographic, defamatory, libelous, hateful, racially or religiously biased or offensive, or unlawfully threatening or harassing to any individual, partnership or corporation;

• Submit content in exchange for payment or other consideration from another person or entity;

• Make the Platform available to anyone else, including sell, resell, rent or lease;

• Use the Platform in connection with unsolicited commercial messages;

• Violate any anti-spam or similar law;

• Use the Platform to store or transmit infringing, libelous or otherwise unlawful or tortious material, or to store or transmit material in violation of third-party privacy rights;

• Use the Platform to store or transmit malicious code or malware, or to engage in phishing or other fraudulent activity;

• Interfere with or disrupt the integrity or performance of the Platform or any data contained therein;

• Scrape, data extract or data mine, or any related activity, from the Platform or otherwise collect information about other users without their consent

• Submit or link to any Content that:

  • Infringes or violates the intellectual property of rights of any person or entity;

  • Intentionally interferes with the operation of the Tattoo Travelist Platform;

  • Breaches any duty of confidentiality that you owe anyone;

  • Provides any non-public information about Tattoo Travelist or any other company or person without authorization (including the names and contact information of Tattoo Travelist employees or other Platform users)

  • Is false, inaccurate or misleading;

  • Is, in our sole discretion, offensive, vulgar, obscene, pornographic, defamatory, libelous, hateful, racially or religiously biased or offensive, or unlawfully threatening or harassing to any individual, partnership or corporation; or that we reject for any other reason in our sole discretion;

  • Contains critical or spiteful comments on other posted Content or their authors;

  • Includes any concerns or claims that could lead to legal action;

  • Contains advertising, pricing, or promotional details referring to any third party’s products or services;

  • Contains any third party’s material that is protected by copyright, patent, trademark, trade secret, other proprietary rights, or rights of publicity or privacy;

  • Violates any law, statute, ordinance or regulation (including, but not limited to, those governing consumer protection, unfair competition, anti-discrimination, or false advertising);

  • For which you have been, or will be, compensated or granted any type of consideration by any person or company;

  • Contains or installs any computer viruses, worms or other potentially damaging computer programs or files; or

  • Contains false or deceptive language, unsubstantiated or comparative claims regarding our or others’ products, advertising, commercial referrals, spam, chain letters, or any solicitation, including solicitation of lawsuits.

Privacy

Any content you post on the Platform is posted at your own risk and can be accessed and used by others. Don’t reveal information you do not want public. Tattoo Travelist does not accept responsibility or liability arising from your disclosure of personal information or any other information in a profile or posting.

 

Policy Enforcement

We reserve the right to pre-screen, verify, edit, monitor or moderate the content posted by users at our sole discretion, including in private groups. Platform monitors have the right, but not the obligation, to edit or remove content and postings at their discretion due to violations of Terms of Use or for any other purpose. We reserve the right to investigate any violation of these Terms of Use and to take appropriate remediation action.

Any violation of these Terms may result in the suspension or termination of your ability to use or participate in the Platform and its associated pages. We reserve the right to enforce these Terms at our sole discretion, including but not limited to, warning users of violations, disabling or suspending privileges and/or access, deleting, screening or editing any content or prohibiting any behavior that does not comply with these Terms, or which we otherwise deem inappropriate, harmful, objectionable or inaccurate.

 

No warranty

THE PLATFORM IS PROVIDED “AS IS,” EXCLUSIVE OF ANY EXPRESS OR IMPLIED WARRANTIES WHATSOEVER. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CONTENT POSTED BY ANYONE OTHER THAN US ON THE PLATFORM IS THE SOLE RESPONSIBILITY OF THE ORIGINATOR OF THAT CONTENT. WE ARE NOT RESPONSIBLE FOR ANY CONTENT POSTED BY YOU OR ANY THIRD PARTY, WHETHER OR NOT WE REVIEWED OR MODERATED SUCH CONTENT. CONTENT POSTED BY US ON THE PLATFORM ARE NOT PART OF ANY USER GUIDE OR LEGAL AGREEMENT. ALL SUCH AFOREMENTIONED CONTENT IS PROVIDED “AS IS”, AND WE DO NOT MAKE ANY REPRESENTATION AS TO ITS QUALITY OR ACCURACY, AND WE SPECIFICALLY DISCLAIM THE ACCURACY, COMPLETENESS, RELIABILITY, USEFULNESS, NON-INFRINGEMENT, QUALITY OR ORIGINALITY OF SUCH CONTENT. No Damages

You agree that you bear all risks associated with using or relying upon content on the Platform. IN NO EVENT SHALL WE HAVE ANY LIABILITY HEREUNDER TO YOU FOR ANY LOSSES OR DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR DAMAGES BASED ON LOST PROFITS, DATA OR USE, HOWEVER CAUSED AND, WHETHER IN CONTRACT, TORT OR UNDER ANY OTHER THEORY OF LIABILITY, WHETHER OR NOT YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

Indemnity

You will indemnify and hold Tattoo Travelist, LLC and its affiliates and their respective officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers harmless from all claims, demands, liabilities, losses, costs, expenses, and damages (actual and consequential) of every kind and nature, known and unknown (including reasonable attorney’s fees), arising out of a breach of any of your representations, warranties, and agreements set forth above, or your violation of any law or the rights of a third party, or your use of the Platform. The failure of Tattoo Travelist, LLC to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.
